SO HOW DOES U.S BUSINESS VISA WORK?

Tens of thousands of investor visas are issued to people coming into the U.S. every year.
There are two types of visas for this: EB-5 Visa and E-2 Visa.

To qualify for an EB-5 visa, you have to make a minimum investment of $900,000
and create at least ten American jobs.
This is beyond the reach of majority potential franchisees.

The E-2 visa has lower requirements and a lot of advantages.
It requires a “substantial investment,” and the minimum is $100,000+

HOW HARD IS IT TO GET AN E-2 VISA?

If you meet the criteria,
then the E-2 visa is one of the easiest ways into the U.S.

With an approval rate of 88%. But remember that U.S. consulates and embassies provide clear standards for what will make a successful application,
though their officers maintain discretion over your approval.

If your E-2 visa is denied, you will be told what visa requirement you didn’t meet.

This lets you modify your application to gain approval the second or third time around.
E2 visa rules do not set up limit on the number of submissions.

What are the benefits of E2 Visa?

The E-2 Visa offers many benefits.
It is like a little backdoor to the U.S.A!

THE APPROVAL for an E-2 visa can vw amazingly fast. If you pay U.S Government for the expedited processing, in two weeks USCIS will send you their decision. (In contrast, all other visas takes 8-29 months to wait for the approval.).

CAPITAL can be as low as $100,000, and most of the start-up fees qualify as capital.

THE BUSINESS can be anything from services to products, start-ups to a franchise, or you can even grow your existing business.

IT IS PERPETUAL – you can stay in the U.S indefinitely so long as your business is doing well.
Basically you can live all your life in the U.S on E2 visa

YOUR FAMILY gets to come with you, including your spouse and children under the age of 21.

EDUCATIONAL ADVANTAGE of E-2 visa allows children to enter the U.S. educational system immediately. Children can attend public school (K-12) for free. Many state universities offer FREE college education for residents of the home state.

SPOUSES are allowed to work, which is a great way to make your family prosperous.

NO LIMITS for the number of E-2 visas for citizens of any Treaty country.

NO LANGUAGE requirements for E-2 visa.

YOU SHOULD MAKE A VERY GOOD MONEY WHILE ENJOYING LIFE IN THIS AMAZING COUNTRY

How to go from an E2 Visa to Green Card?

Yes, there are a few things to go over:
The E2 visa is a non-immigrant visa category. This means that the E2 visa is temporary and does not directly lead to a green card.

So, to get a green card you will have to apply for an immigrant visa or adjust status to an immigrant status.

Remember, the E2 visa requires you to have the intent to depart the United States once your E2 status is terminated.

Still, you cannot be denied E2 status just because you get approved for an immigrant visa petition.
This means that you can apply for an immigrant visa or adjust status in the US while you have an E-2 visa.
Now that you know the basic issues, lets discuss the different green card options.

Green Card Options:

EB-5 Visa

The EB-5 visa is an investment based immigrant visa. This means that it leads to a green card.

The EB-5 visa requires that you invest a minimum of $1.8 million in a US business. Or, you can invest $900,000 if the investment is located in a targeted employment area.

Your investment must also lead to the creation of 10 full-time jobs for US workers.

The benefit of transferring from an E2 visa to an EB-5 visa is that in some cases, your investment to get the E2 visa will count for your EB-5 visa.
Also, if you’ve created jobs for your E2 business, these jobs may also count for your EB-5 visa.

If you already invested a lot of capital in the E2 business, and created enough jobs, you may be able to get an EB-5 visa with little effort.

Family Based

Your close family members that are US citizens or lawful permanent residents may be able to sponsor you for a green card.

Spousal

You may qualify for a green card if you enter into a legitimate marriage with a US citizen.

H-1b Employment Based

You may qualify for a green card if a US company offers you a job and sponsors your green card.
The US employer would have to get a Labor Certification through the US Department of Labor.

EB-1 A Visa

The EB-1 A visa is for people with “extraordinary ability.”
The benefit of this visa is that you can self-petition. This means that you can apply for your green card without a company sponsoring you.

EB-2 National Interest Waiver

The EB-2 visa is for people with “exceptional ability” or “advanced degree professionals.”
The unique aspect of an EB-2 visa is that, along with an EB-2 visa, you can apply for a “National Interest Waiver.”
With a National Interest Waiver, you can apply for an EB-2 visa without a US company sponsor.

To get a National Interest Waiver, you must show that it is in the national interest of the United States, to allow you entry without a US company sponsor

How much do I need to invest?

One of the questions we get asked the most is “what is the E2 Investor Visa Minimum Investment Amount?”

It is a good question because everyone seems to be aware that the investment for E2 visa purposes must be substantial, but the question then becomes, “what is considered substantial?”

Under the E-2 visa regulations, the E2 Treaty Investor applicant must demonstrate that a substantial investment of personal funds has been invested in the E2 Enterprise and that the investment must be “at risk” and dedicated to the development and growth of the U.S. enterprise.

A substantial investment is determined by the proportion of funds being invested compared to the total cost to develop the business to the point of being operational.
Therefore, no minimum investment amount is specified in the regulations.

There is no set minimum investment amount to qualify for an E2 visa. Investments as low as $50,000 or even lower have qualified for E2.

Let's look at statistics. It is unique data that
was collected by U.S Governments.

(it is not so easy to find and you will not see it anythere else)

Looking at this chart.
We can clearly are capable to make several conclusions.

CONCLUSION #1.
THAT BIGGEST NUMBER OF E2 VISA APPROVAL WERE HAPPEN TO APPLICANTS WHO INTESTED $100,000- $200,000

CONLUSION #2.
THE MITH THAT U.S IMMIGRATION DOES NOT APPROVE INVESTNTMENTS LOWER THAT $100,000 IS NOT TRUE.
IN FACT, INVESTMENT FROM $50,000 TO $100,000 ARE REPRESENT THE SECOND BIGGEST NUMBER OF APPROVED E2 VISAS.
STILL, WE NEED TO BE VERY VERY CAREFUL ABOUT THIS FACT.
WE KNOW NUMBER OF APPROVAL IN THIS INVESTMENT RANGE
BUT WE DO NOT KNOW NUMBER OF DENIALS!

CONCLUSION #3.
SURPRISINGLY, EVERY TENTH (1/10) E2 VISA APPLICANT IS INVESTING MORE THAT $1,000,000

CONCLUSION #4
DO NOT INVEST LESS THAN $50,000

he amount of investment should correlate to the cost of the endeavor.
This means that the higher the price of the business, the more capital must be invested in order to qualify

According to the USCIS:

an investment is “the treaty investor’s placing of capital, including funds and/or other assets, at risk in the commercial sense with the objective of generating a profit.

The capital must be subject to partial or total loss if the investment fails.

The treaty investor must show that the funds have not been obtained, directly or indirectly, from criminal activity”.

https://www.uscis.gov/working-in-the-united-states/temporary-workers/e-2-treaty-investors

The term substantial capital can be defined as an investment that is:

Significant as it relates to the entire purchasing price of a business that has already been established or the price of establishing a new business.

Enough to ensure that the investor is irrevocably committed to the success of the business.

Enough to substantiate the idea that the investor will be able to enhance and operate the business so that it will be a positive impact on the U.S. economy.

The amount of investment should correlate to the cost of the endeavor.
This means that the higher the price of the business, the more capital must be invested in order to qualify

BUT,

2. What Are The Practical Steps To Insure That
My $100K Will Not Be Stolen?

THREE SIMPLE BUT NOT EASY RULES

Do that, - set up your own company and bank account in the U.S. After that, transfer your money there.

DON'T do this, - transfer your money to a "friend", or distant relative in the U.S

Do that, - buy well known franchise, which is regulated by U.S Government.

DON'T do this, - buy an existing small business from a random seller.

Do that, - if you decided to start a new business, do it on your own. NO partners.

DON'T do this, - start new business with a partner, especially who speaks your language.***

***Statistically, this is #1 way to loose your money.

Do that, - pay typical regular prices for your immigration services.

DON'T do this, - try to find a super-cheap price.
At the end, it will be the most expensive one.

FREQUENTLY ASKED QUESTIONS

The E-2 Visa, otherwise known as the Investor Visa, is a non-immigrant visa that allows entrepreneurs and business owners to enter and work in the United States based on an investment in a business that they will be actively managing and controlling while residing in the US.  as long as they want.

The first step for any potential E-2 investor considering the E-2 investment visa is determining whether you are eligible to apply for it.

To apply for an E-2 visa, you must be a national of a Treaty Country with a valid passport of this country.

No, so long as you qualify as a national of an E2 Visa Treaty Country, your wife or husband and children do not have to be from a Treaty Country.

In evaluating E-2 applications, consular officers must determine E2 Visa Requirements whether the:

1) Requisite treaty exists;

2) Individual and/or business possess the nationality of the treaty country;

3) Applicant has invested or is actively in the process of investing;

4) Enterprise is a real and operating commercial enterprise;

5) Applicant’s investment is substantial;

6) Investment is more than a marginal one solely for earning a living;

7) Applicant is in a position to “develop and direct” the enterprise;

8) Applicant, if an employee, is destined to an executive/supervisory position or possesses skills essential to the firm’s operations in the United States; and

9) Applicant intends to depart the United States when the E-2 status terminates.

The E2 Investor Visa is for from three months to five years, depending on your country of nationality, and can be extended indefinitely.

We still take 1 to 2 months to file, but the consulates are extremely backlogged and take 6 months to arrange interviews. UNLESS, you pay U.S Government expedited fee of $2,500 and You will get your anwer in 14 days!

As the backlogs are dealt with, those dates will go back to normal processing times.

Yes, your husband or wife can obtain a work permit, also known as the EAD, which takes 90 to 120days after you get your visa.

NO.

But Your spouse easily can get U.S work authorisation and work anywhere.

All kids under the age of 21 years old will be allowed to come with you to the US on an E-2 and study.

Social Security Numbers never expire, so if you’ve had one in the past, you still have one..

There is no minimum value according to USCIS rules, regardless of what you read on the internet.

The investment has to be substantial for the type of business you choose to invest in.

However, our company has chosen to place a minimum for what we will handle at $60,000.

The Applicant must prove that they are in possession and control of the funds (the money is theirs) and that they received the money by legitimate means. The funds can be from savings, inheritance, gifts, and loans. So yes, a loan can qualify for investment funds so long as the new business’ assets do not secure the loan. All funds must have originated from a legitimate source, which means the US Government will want to know where your money in savings came from (how did you get it) and even if a gift the how the person giving you the money received the money must be proven.

Thus, the answer to the question Can I use a Loan for my investment is yes so long as it is not secured with the business’ assets.

There is a great deal of documentation required here to “trace” the source of the funds from beginning to end (the end being the business’ bank account). Some examples of documents would include; Bank Statements, Loan documents, Pay Statements from a prior job, Wire Transfer Receipts, and more.

Any expense both current and past that is directly related to the operations or startup of the business can qualify as your E2 investment.

For example:

– trips to the US for the purpose of business acquisition or site review

– office expenses

– legal fees

– business consulting fees

– cars if required for the business

– company setup

– marketing expenses

– phones, laptops

– leases

– inventory

– equipment

– patents and IP

– software licenses

– required business or personal licenses

The E2 visa investment money must be ‘committed and at risk’ for it to qualify as an investment prior to applying for the visa.

This means that you have to spend the money on business expenses, not just have it sitting in your bank.

You are allowed to maintain some cash as working capital.

Our company likes to keep the Client’s cash in the bank – working capital – at or below 10% of the total investment.

NO, you still own all the assets of your business.

The only difference is that you cannot stay in the U.S, you much manage your business from abroad.

In almost all cases, the answer is NO. However, if the home is an integral part of the business, then you can.

So for example, a working farm where the home is part of the overall business would count.

Or if your business is remodelling of the houses.

The list is almost unlimited. However, businesses that earn passive income only such as real estate investment is prohibited. It has to be a business that you actively run.

Yes, up to 50% of the business.

Yes, after you get your visa, if there is a true business need, they would qualify for an ‘Essential Employee Visa’.
